Website Privacy Policy

OVERVIEW

Thank you for visiting the Ampersand website (“Website”), which is owned and operated by National Cable Communications LLC d/b/a Ampersand (“Ampersand,” “we,” “us,” “our,” or other similar pronouns). Ampersand’s registered name is National Cable Communications LLC and does business as Ampersand.

This privacy policy (“Privacy Policy”) applies solely to information collected on Ampersand’s corporate site, Ampersand.tv, and subdomains thereof that display or link directly to this Privacy Policy (collectively, “Sites”). By accessing or using the Sites, you agree to the terms of this Privacy Policy and our Terms of Use, as they may be amended from time to time.

This Privacy Policy does not apply to data collected through Ampersand’s advertising and technology services or its career page.

This Privacy Policy applies to data collected from visitors to our Sites. It serves as notice at the point of the collection of information from you.

Your privacy is a serious matter to Ampersand. Ampersand has created this Privacy Policy to inform you of what data we collect and how we use, share/disclose, and secure such data.

Please take a few minutes to read our Privacy Policy so that you understand how Ampersand treats the information it collects from you when you visit its Sites.

This Privacy Policy does not apply to any third-party websites, products, or services that you may be able to access through this Site. We suggest contacting those sites directly for information on their privacy practices.

What data do we collect? How do we collect and use such Data?

Ampersand collects information from you depending on how you interact with its Website. This section describes the categories of information Ampersand collects, the sources of this information, and how Ampersand uses the information, with more details provided further below in this Privacy Policy. Ampersand may have collected these categories of personal information in the past 12 months.

DISCLOSURE (“SALE”) OF PERSONAL INFORMATION

The California Consumer Privacy Act of 2018 (as amended, and together with related regulations the “CCPA”) broadly defines the term “sale” to mean:

“Selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer’s personal information by the business to a third party for valuable consideration; or (B) sharing orally, in writing, or by electronic or other means, a consumer’s personal information with a third party, whether for valuable consideration or for no consideration, for the third party’s commercial purposes.”

Within this meaning, we may have disclosed (as that term is defined by the CCPA) Personal Information in the categories listed above from our Website visitors within the last twelve months where such disclosure may fall within the CCPA’s definition of a “sale.” When we disclose that we may have sold Personal Information, it means that we may have received some kind of benefit to Ampersand in return for sharing Personal Information, it does not necessarily mean we received any money in exchange.

The categories above are those defined in the CCPA. This does not mean that all examples of that category of Personal Information were in fact “sold” but reflects our good faith belief to the best of our knowledge that some of that information may have been shared for value in return. We will update this disclosure from time to time as appropriate. In response to a verified consumer request for categories of Personal Information “sold,” we will investigate and provide an individualized response to the consumer, and will not merely refer the consumer to our general practices outlined in this Privacy Policy unless our response would be the same for all consumers and this Privacy Policy discloses all the information that is otherwise required for the response to such a consumer request.

We may disclose Personal Information we collect for “business purposes” or “commercial purposes” (as defined under the CCPA), which may include the following examples. The examples provided are illustrative and not intended to be exhaustive.

(a) Auditing Interactions with Website Visitors. For example: monitoring traffic to our Website, counting ad impressions, and auditing legal and regulatory compliance.

(b) Security. For example, maintaining the safety, security, and integrity of our Website and our business, including preventing fraud, detecting security breaches and prosecuting violators, and responding to law enforcement requests or court orders and to comply with any applicable laws and regulations.

(c) Debugging/Repair. For example, identifying and repairing errors in our Website’s functionality.

(h) Other Commercial Purposes. Examples include: (i) purposes as described to you when collecting your Personal Information, such as providing you with information regarding our Services: (ii) to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, in which Personal Information we hold is among the assets transferred; and (iii) Any other purposes disclosed to you at the time we collect your Personal Information and/or pursuant to your consent.

If we decide to collect additional categories of Personal Information or use the Personal Information we collected for materially different, unrelated, or incompatible purposes we will update this Privacy Policy.

In response to a verified consumer request to know what Personal Information was collected or sold, we will investigate and provide an individualized response to the consumer, which will include the business or commercial purpose for collecting and/or sharing that information. We will not merely refer the consumer to our general practices outlined in this Privacy Policy unless our response would be the same for all consumers and this Privacy Policy discloses all the information that is otherwise required for the response to such a consumer request.

Disclosing Personal Information to Other Parties

As outlined above, we may disclose your Personal Information to the following categories of other parties for a business purpose or commercial purpose, as those terms are defined in the CCPA:

  • Service providers: such as data processors, hosting companies, customer service providers, contractors, agents or sponsors who help us manage or provide our products and services by, for example: developing or supporting products and features; sending email messages on our behalf; processing payments; fulfilling orders; delivering subscriptions; auditing; processing data or statistics; and serving, customizing or delivering marketing. These third-party service providers are required to protect Personal Information entrusted to them and not use it for any other purpose than the specific service they are providing on our behalf.
  • Advertisers, advertising technology companies, Social Media Platforms, analytics companies and other third parties with whom we have business relationships.
  • Government regulators.
  • Our legal advisors and parties involved in a legal process.

We may combine this information with other information we have, or that we collect through other sources, and may share the information we collect with third parties to provide interest based or targeted advertising and content, including textual and/or audio-visual ads or content. In addition, our advertising partners and Social Media Platforms may use information received from us to combine it with other information they may have about you obtained through other sources or through your relationship with them. If you would like to opt out from this use, or for more information, please see our Cookie Policy which includes links to specific third party opt-outs.

Please be aware that we are not responsible for the privacy practices of these other content providers, or any other, third party sites. These third-party websites, content and resources may use their own cookies to collect data or solicit and use your Personal Information in ways different than set forth in this Privacy Policy. The social media sites may receive data when you visit a website that has plugins. In some cases, Ampersand may know that you clicked on a social plugin such as a Facebook Like button or receive other information from the social media providers. Similarly, if you have previously provided personally identifiable information to a third-party operating a plug-in on this Site, then this third-party may recognize you on this Site. Your use of social network plugins is subject to each social media provider’s privacy policy, which may be different from ours, so please read these policies carefully to understand their policies and your options. Browsing and the use of cookies, Web beacons and other tracking technologies

Ampersand uses cookie technology as part of Site’s statistical reporting and for other purposes related to making the Site available to you. A cookie is a small piece of information sent by a website that is saved on your hard disk by your computer’s browser. It holds information a website may need to personalize your experience. We may also utilize cookies to identify if you are logged into a Site account.

A Web beacon is an electronic image, also called a single-pixel or clear GIF, placed in the code of a webpage or in emails. The Sites uses Web beacons to track traffic patterns of users as they navigate from one page to another. This information lets us tune and improve our users’ browsing experience. As with cookies, the information that Web beacons collect is aggregated, “click stream” data that is not directly identifiable to you as an individual.

We also use Web beacons through a third-party website analytics provider, as well as standard Web server log files, to help us count visitors and evaluate the Site’s technical capacity. This information tells us how many people visit the Sites and helps us decide how to arrange pages in the most user-friendly way. This also helps us keep the Sites’ browser-friendly and more useful to our users.

Deidentified Data

When in possession of de-identified data, Ampersand takes reasonable measures to ensure that any de-identified data it possesses cannot be associated with an individual and will maintain and use such data as de-identified data.
